These Terms of Service (“Terms”) govern your access to and use of the website, applications, and services (collectively, the “Services”) operated by:

By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services.

1. Welcome

Tons of Tongues provides adult-oriented user-generated content to consenting adults. The Services function as a platform hosting content uploaded by independent creators.

2. Eligibility & Age Representation

You must be at least eighteen (18) years of age or the age of majority in your jurisdiction to use the Services.

By using the Services, you represent and warrant that:

  • You are at least 18 years old;
  • You have the legal capacity to enter into a binding agreement;
  • All information you provide is truthful and accurate.

False age representation constitutes material breach and may result in immediate termination.

3. Nature of the Platform

Tons of Tongues LLC operates as an interactive computer service provider hosting user-generated content.

We do not produce, direct, or control content created by independent users. We reserve the right, but not the obligation, to review, remove, restrict, or suspend content or accounts at our sole discretion.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account.

You agree not to:

  • Share accounts;
  • Impersonate others;
  • Upload unlawful, abusive, infringing, or unauthorized content;
  • Attempt to circumvent platform safeguards.

5. Content Ownership & License

Creators retain ownership of their content.

Purchasing a subscription or unlocking content grants you a limited, non-exclusive, non-transferable license to view that content for personal, non-commercial use only.

You may not:

  • Copy;
  • Record;
  • Download;
  • Redistribute;
  • Reproduce;
  • Commercially exploit any content.

Unauthorized use may result in termination and legal action.

6. Creator Obligations & 2257 Compliance

Creators represent and warrant that:

  • All individuals depicted are at least 18 years old;
  • Valid government-issued identification has been obtained;
  • Required model releases are maintained;
  • Content complies with applicable laws, including:
  • 18 U.S.C. § 2257
  • 28 C.F.R. Part 75

Creators must maintain accurate records and provide documentation upon request.

Failure to comply may result in suspension or permanent removal.

7. Prohibited Content

The following content is strictly prohibited:

  • Content involving minors;
  • Non-consensual material;
  • Deepfake or manipulated media depicting real persons without consent;
  • Stolen or infringing copyrighted material;
  • Trafficking-related material;
  • Harassment or abuse.

We reserve the right to report violations to law enforcement.

8. Payments, Refunds & Chargebacks

All purchases are final once content has been accessed.

We reserve the right to:

  • Hold or delay creator payouts;
  • Apply payout holds in cases of disputes or chargebacks;
  • Reverse earnings resulting from chargebacks or fraudulent activity;
  • Suspend or terminate accounts in cases of fraud or abuse.

Chargebacks may result in immediate account suspension or termination.

We are not liable for interruptions caused by third-party payment processors.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tons of Tongues LLC, its members, officers, employees, and agents from any claims, damages, liabilities, losses, and expenses (including legal fees) arising from:

  • Your use of the Services;
  • Your content;
  • Your violation of these Terms;
  • Your violation of applicable law.

10. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE.”

We make no warranties regarding availability, security, uninterrupted access, revenue generation, or error-free operation.

11. Limitation of Liability

To the fullest extent permitted by law, Tons of Tongues LLC shall not be liable for indirect, incidental, consequential, special, or punitive damages.

Total liability shall not exceed one hundred U.S. dollars ($100).

13. Termination

We may suspend or terminate access at any time for violations of these Terms or applicable law.

No refunds will be issued upon termination.

Sections relating to indemnification, limitation of liability, and dispute resolution survive termination.

14. Force Majeure

We are not liable for delays or failures resulting from events beyond our reasonable control, including government action, cyberattacks, hosting failures, or payment processor restrictions.

15. Dispute Resolution; Binding Arbitration

These Terms are governed by the laws of the State of Washington and applicable U.S. federal law.

Except for small claims matters, disputes shall be resolved through binding arbitration administered by the American Arbitration Association.

You agree to resolve disputes individually and waive participation in class actions.

You waive the right to a jury trial.

Arbitration Opt-Out (30 Days):

You may opt out of arbitration by sending written notice within thirty (30) days of account creation to:

Failure to opt out within 30 days constitutes acceptance.

16. Modifications

We may update these Terms at any time. Continued use of the Services after updates constitutes acceptance.
